LEARNING ACTIVITY Read the case study, then discuss the questions that follow it with your classmates. In the scenario, the NPâs failure to
recognize the potential for suicide in
an adolescent resulted in permanent
disability: An insured NP(nurse practitioner) certified in child and adolescent psychiatry
began treating a 16-year-old patient for
anxiety and depression. The patient had
a medical history significant for fibromyalgia and a history of attempting
suicide. After 6 months of therapy and
medication treatment, the patient
overdosed on oxycodone pills belonging to her stepfather. The patient
suffered brain hypoxia and currently
resides in a residential health-care facility. The patientâs family is suing the NP for malpractice. The
attorney for the family argues that the
NP was negligent in managing the patientâs depression and anxiety and failed to recognize the patientâs
risk for suicide. ⢠Given the patientâs
high risk for suicide, what other
precautions might the APN(advanced practice nurse) have taken? ⢠How strong is the
familyâs claim of malpractice? What
evidence could they use to support the four elements of their malpractice claim: ⢠Duty of care â¢
Substandard care ⢠Proximate cause ⢠Injury ⢠How might the
medical outcome and legal liability of this case have been different if the
APN had consulted with a psychiatrist or
clinical psychologist colleague? ⢠The APN is served
with a copy of a suit including the summons and complaint filed by the plaintiff. What should the APN do next?
What should he or she NOT do? NB: Discussions must be backed up with PEER reviewed journal articles
