Human rights, patient rights, civil rights are terms used to describe specific rights under varying circumstances. Because human rights trump all other rights and because they don’t address other areas of life that may be affected if specific guidelines are not mandated and enforced so that people are protected for instance, historical antecedents in health research, biomedical experiments, and healthcare practices have shown that communities and specific cultural groups were unethically treated. Moreover, happenings in many modern healthcare institutions are replete with abusive and discriminatory care practices, as cited studies. Hence, the right to health and patients’ rights have become critical human rights issues in several countries. National patients’ rights charter, service pledges, codes of ethics, and standards of practices for various healthcare professional groups are being developed to safeguard patients’ rights (Kwame, A., & Petrucka, P. 2022). It is necessary for implementation of rights in areas were people are most vulnerable and it was apparent at an early stage that medical treatment would be an area of major concern if not regulated and controlled by layers of governmental controls and layers of universally understood outcomes and rights that give the people some type of control and expectation of the outcome of their treatment. According (Arrow, 1978) patients can be construed as consumers only if they are operating within a market. But health care is not a market in the usual way that markets are defined, and so patients do not have the power that consumers have to shape that market. Patients are not as well informed as physicians are about medical care. Often patients do not have well-formed preferences, and they seek care under circumstances in which they do not have the time or emotional stamina to shop around on the basis of quality and price. And if policy makers treat health care like any other market, there will likely be very limited cost savings, if any, and huge inequities will continue and likely increase. My preconceived notion’s of patient rights have been abolished, spending time in a prison has give me unique perspective on human rights moreover patient rights, prior to my assignment in a maximum security prison my thinking was that all prisoner lose their right but this in not true, inmates have rights that must be upheld and the right to adequate health and mental health care is governed by regulatory guidance established to protect the inmates from gross mistreatment.
